1. Introduction
These Terms of Service ("Terms") govern access to and use of Hoskes Hoster ("Service"), operated by HOSKES DESENVOLVIMENTO DE SISTEMAS LTDA ("Hoskes", "we", "us"), CNPJ 53.371.345/0001-18, with operations at São Paulo, SP, Brazil.
By creating an account, using our desktop or mobile apps, subscribing to a premium plan, or accessing https://hoskes.com, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Hoskes Hoster lets you host LAN game servers, share games with friends without a traditional VPN, use custom subdomains (*.hoskes.top), publish servers, and access premium features such as dedicated Minecraft hosting.
Features may include the Hoskes Hoster application (Windows/Android), web dashboard, tunnel configuration, friends list, premium rewards, and payment via card (Stripe) or PIX (Mercado Pago). We may add, change, or remove features at any time.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for maintaining the security of your account credentials and sessions.
You must provide accurate registration information and notify us of unauthorized access at support@hoskes.com.
4. Plans and usage limits
We offer Free and paid plans (Silver, Gold, Platinum) with different features and limits. Current plans and pricing are described on our Plans page and may change with notice.
You may not circumvent plan limits, abuse free tiers, or use the Service in a way that degrades performance for other users.
5. Acceptable use
You must comply with our Acceptable Use Policy. You are solely responsible for games, mods, and content you host. We may suspend or terminate accounts that violate applicable law or our policies.
6. Third-party integrations
When you link Discord, you authorize us to access profile information per the OAuth scopes you approve. You remain subject to Discord's terms.
Payments are processed by Stripe (card) and Mercado Pago (PIX). Third-party services have their own terms. We are not responsible for third-party outages or policy changes.
7. Your content and intellectual property
You retain ownership of your game data and server content. You grant Hoskes a limited license to host, copy, and process your content solely to provide the Service.
Our platform, brand, documentation, and software are owned by Hoskes and protected by intellectual property laws.
8. Availability and modifications
We strive for high availability but do not guarantee uninterrupted service. Maintenance, updates, and incidents may cause downtime.
We may modify or discontinue the Service or these Terms. Material changes will be communicated via the website or email. Continued use after changes constitutes acceptance.
9. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
To the maximum extent permitted by law, Hoskes shall not be liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or goodwill. Our aggregate liability shall not exceed the fees you paid to Hoskes in the twelve months preceding the claim, or BRL R$100 if you use the Free plan.
10. Indemnification
You agree to indemnify and hold Hoskes harmless from claims arising from your use of the Service, your hosted games or servers, violation of these Terms, or infringement of third-party rights.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your account for violations, non-payment, or risk to the platform.
Upon termination, your right to use the Service ends. We may delete account data after a reasonable retention period, subject to legal obligations.
12. Governing law
These Terms are governed by the laws of Brazil. Disputes shall be submitted to the courts of São Paulo, SP, Brazil, unless mandatory consumer protection law provides otherwise.
